Currently if you offer a draw, your opponent has all the time to accept it or decline before playing a move - and this is fine. But some take advantage of another mechanic, that is to automatically accept the draw if you run out of time.
In a result, if you were in a long time control match and you offer a draw, you have to wait for whatever your opponent had time on the clock, otherwise he can miracoulosly come back after let's say 30 minutes and play another move and you will lose for running out of time.
There is currenlty some system to decide if your opponent left the game or is still thinking on the move and usually it let you decide to claim a victory or declare a draw. But it is not in the use if you offer a draw. So my suggestion would be, that if you offer a draw and your opponent left the game just prompt the usual "claim victory" or "declare draw" option.
