run out of time with mate in one

In an online game this is as it should be and can not be changed.

OTB it is also in the rules that you lose in time, BUT atleast in my country mate on board rules over time loss, so even if your time is out, just move and checkmate and say "mate on board" and it's your win.

Actually I don't see a mate on the board.

(If an arbiter claims "time" you don't make a further move, do you?)

Usually there is no arbiter present, it's a pretty rare situation, so I have never seen one with an arbiter present. I have claimed the win by mating with my time dropped however.

It might be an unwritten rule, based on the fact that it's impossible to determine if mate was made before flag dropped.

But I think it's fair, since it's pretty silly to try to win a game where you are mated.
If you play with your grandpa in the armchair you can play without any clock or mate in 3 overrules time-out. I play rarely a tournament game without an arbiter which is mandatory for Elo rating of the tournament.

The example above: the FEN says no ep allowed, in a tournament game I would replay the game and check the notation first.

PS: of course "mate over flag", but if someone claims time the position at that points counts because it hasn't been altered via a completed move.
@Sarg0n : I didn't put the full FEN in the URL for a reason (even though actually clicking the link defaults to white to move no castling no e.p.) It's a retro problem: You can work out the correct result by pure logic (with the assumption that only legal moves were played from the normal starting position, of course.)

Sure, the time win would prolly count in the presence of an arbiter. There are arbiters in my tournaments too, not 1 arbiter for every board however (so arbiter rarely is there to see the situation), infact, one has to be called to the board if needed.

I recommend just making the move and mating no matter if your flag has dropped or not. No point in getting a loss from a won game. If arbiter says time win stands, so be it.
Sure. If my flag fell, nobody complained, I would possibly deliver mate as well... :D
